Account Terms

1. You must be at least 18 years of age to access or use this Service.
2. You are required to provide your full legal name, current address, valid email address, and any other necessary information to complete the account creation process.
3. You are solely responsible for maintaining the confidentiality of your password. ShipKia will not be held responsible for any loss or damage resulting from your failure to safeguard your account credentials.
4. You must not use the ShipKia Service for any illegal or unauthorized activities, nor violate any applicable laws within your jurisdiction (including but not limited to copyright laws) or the laws of India.
5. You are accountable for all activities and content (including data, images, graphics, and links) uploaded through your ShipKia account.
6. You must not upload, distribute, or transmit any worms, viruses, or malicious code of any kind.
7. Any breach or violation of these Account Terms, as determined solely by ShipKia, may result in the immediate suspension or termination of your access to the Service.

General Conditions

Before becoming a member of ShipKia, you must read, agree to, and accept all the terms and conditions outlined in this User Agreement and the Privacy Policy.
1. We reserve the right to modify, suspend, or terminate the Service at any time, for any reason, without prior notice.
2. We reserve the right to deny service to any individual or entity, at any time, for any reason.
3. Your use of the Service is entirely at your own risk. The Service is provided on an “as is” and “as available” basis, without any warranties or conditions of any kind, whether express, implied, or statutory.
4. ShipKia makes no warranty that the Service will be uninterrupted, timely, secure, or error-free.
5. ShipKia makes no warranty that any results obtained through the use of the Service will be accurate or reliable.
6. You understand that your Content (excluding credit card details) may be transmitted unencrypted and may involve:
(a) transfers across various networks; and (b) modifications to meet the technical requirements of connecting networks or devices.
7. We may, but are not obligated to, remove any Content or Account that we, at our sole discretion, determine to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or in violation of any party’s intellectual property rights or these Terms of Service.
8. ShipKia makes no warranty that any products, services, information, or materials purchased or obtained through the Service will meet your expectations or that any errors within the Service will be corrected.
9. You expressly acknowledge and agree that ShipKia shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising from the use or inability to use the Service.
10. In no event shall ShipKia or its suppliers be liable for lost profits or any special, incidental, or consequential damages resulting from or connected to our site, services, or this Agreement (however caused, including negligence). You agree to indemnify and hold harmless ShipKia, its parent company, subsidiaries, affiliates, partners, officers, directors, agents, and employees from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of your breach of this Agreement, incorporated documents, applicable laws, or violation of third-party rights.
11. Technical support is available only to paying account holders and is provided via email or, if previously agreed, through phone or ticketing support.
12. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, its use, or access without the express written consent of ShipKia.
13. Any form of verbal or written abuse (including threats or acts of retaliation) directed toward a ShipKia customer, employee, member, or officer will result in immediate termination of your account.
14. ShipKia does not claim ownership of any intellectual property rights over materials you provide through the Service.
15. By uploading images or item descriptions to shipkia.com, you grant permission for other internet users to view them and authorize ShipKia to display, store, and review such content at any time.
16. The failure of ShipKia to enforce any right or provision under these Terms shall not constitute a waiver of such rights or provisions. These Terms of Service constitute the entire agreement between you and ShipKia and supersede any prior agreements (including earlier versions of these Terms).
17. You shall not purchase search engine or pay-per-click keywords (such as Google Ads) or domain names that include ShipKia trademarks or any variations or misspellings thereof.
18. ShipKia does not pre-screen Content and reserves the right, at its sole discretion, to refuse or remove any Content made available through the Service.

Payment of Fees

1. ShipKia offers multiple payment term options. Based on the terms agreed upon with ShipKia, the merchant shall make payments on a pre-decided monthly, quarterly, half-yearly, or yearly basis.
2. All payments must be completed within 7 days from the date of the invoice. Failure to do so may result in the suspension or termination of the merchant’s online store.
3. Merchants can also use the ShipKia Wallet to add and maintain funds for faster and seamless payment settlements. Any dues or service fees may automatically be deducted from the wallet balance as per the agreed payment terms.
4. All fees are exclusive of applicable taxes, including but not limited to state and central taxes, service tax, sales tax, or any other charges imposed now or in the future (“Taxes”).
5. ShipKia does not provide refunds for any fees or charges once paid. ShipKia also does not refund the Wallet Balance.

Modifications to the Service and Prices

1. The prices for using ShipKia’s services may change without prior notice. Such notice can be given either through an update on the ShipKia website (shipkia.com) or via an official announcement.
2. ShipKia reserves the right, at any time, to modify or discontinue the Service (or any portion of it), with or without prior notice.
3. ShipKia shall not be held responsible to you or any third party for any modification, price adjustment, suspension, or discontinuation of the Service.

Banned Products and Services

You shall not, directly or indirectly, offer, attempt to offer, trade, or attempt to trade in any item whose sale, purchase, or exchange is prohibited or restricted in any manner under any applicable law, rule, regulation, or guideline currently in force.
Without limiting the general scope of the above, Buopso Private Limited strictly prohibits the hosting or listing of the following items:
1. Securities as defined under the Securities Contract Regulation Act, 1956, including shares, bonds, debentures, or any other type of financial instruments or assets.
2. Living or dead creatures, and/or any part or product derived from animals, whether preserved naturally or artificially. This includes rugs, skins, mounted specimens, antlers, horns, feathers, hair, nails, teeth, musk, eggs, nests, and similar items whose sale or purchase is restricted or prohibited under applicable laws, including the Wildlife Protection Act, 1972.
3. Weapons of any kind are also prohibited.
4. Liquor, tobacco products, narcotics, psychotropic substances, intoxicants, medicines, or any other palliative or curative products of any description.
5. Religious items, such as books, artifacts, or objects of any kind, that could potentially offend or harm the religious sentiments of any individual or community.
6. Antiquities and art treasures in violation of the provisions of the Antiquities and Art Treasures Act, 1972 (“the Act”).
7. Used cellular phone SIM cards.
Furthermore, you agree to publish, display, and comply with a “Terms of Use” or equivalent user agreement, along with a Privacy Policy, governing your store’s operations and your interactions with your customers.
